A JUDGE has discharged the jury in a trial over whether a woman caused the death of a lollipop man by driving carelessly.
Lauren Paul, 23, of Holly Drive, Waterlooville, wept in the dock as the jury at Southampton Crown Court was discharged by Judge Peter Henry.
It is the second time in the case that a jury has been discharged.
Paul, who works at South Downs College, had always denied that the standard of her driving had contributed to the death of 82-year-old Ray Elsmore.
Her Nissan Micra hit him as he was helping a mum across the road along Tempest Avenue, Waterlooville, at about 3pm on December 5, 2012 and Mr Elsmore died later that day in hospital.
The Crown Prosecution Service now has 14 days to decide whether it will proceed with the charge.
If it does, another trial could take place at a later date.
Paul was given unconditional bail.
