THE family of baby has been told their daughter cannot have surgery to save her arm from paralysis as they do not have permission to live in the UK.
Eight-month-old Sanika Ahmed needs surgery before she reaches nine months old as she has Erb’s palsy.
The condition means she has a damaged nerve after her right shoulder was trapped under the pelvic bone of mum Syeda, 29, of Pains Road, Southsea, during pregnancy.
The Royal National Orthopaedic Hospital in Middlesex says she cannot have the treatment on the NHS.
In a statement the hospital said: ‘Although Sanika is UK born she is dependent upon her parents and under the provisions of the NHS Overseas Patient Regulations, Sanika was not entitled to free NHS treatment.’
Dad Muhammad, 37, had worked legally in the country after he came from Bangladesh in July 2008 but his work permit expired in August 2009.
The family say they have now applied for leave to stay in the UK.
Swain & Co Solicitors are representing the family and want a judicial review into the hospital’s decision.
The UK Border Agency said it could not comment.
