A BELOVED family pet that went missing was later found tied up in a sack.

Border collie Lucy disappeared after running out of the house.

Owner Chloe Palmer and daughter Tianna, three, of Mandarin Way in Gosport, were left devastated after hours of searching on Sunday proved futile.

But a day later, five-year-old Crystal Taylor found the dog tied up in a gravel bag in nearby Mantle Close.

Now happily reunited with one-year-old Lucy, Chloe wants to thank the girl who found her dog and warn other pet owners in the area to be vigilant.

Chloe, 22, said: ‘I couldn’t believe someone could do something like that. We were about to take her for a walk but she got out of the house.

‘We were all upset and my three-year-old daughter was in tears – we had brought Lucy for her.

‘Then we got a call from the vet and they said she was found in a gravel bag.

‘I burst into tears because we had been looking for her for so long and we feared the worst. Now I want to warn other dog owners to be careful just in case whoever did it gets hold of someone else’s dog.’

Crystal was playing outside her home in Mantle Close when she heard a rustling sound coming from a large sack next to a bin. She untied the bag and found Lucy inside, still wearing a lead and walking harness.

Crystal’s mum, Sally Taylor, 28, said: ‘I went out to check on the kids where they were playing outside and saw my daughter with the dog. She said it was in a bag and it was tied up. It was a big bag. She heard rustling and untied the bag and found the dog. I went over to my friend’s house and she took the dog to the vet.

‘I’m so happy the owners got their dog back; it was a beautiful dog and it was really friendly.’

Luckily Lucy was microchipped and the Alver Vet practice in Forton Road, Gosport, was able to track down the owners after scanning the chip.

Police said they could not find evidence to show a crime had been committed.

A spokeswoman said: ‘A PCSO on patrol in Gosport was stopped by a member of the public who had located a dog. As a result of initial investigations no criminal offences were identified and no crime was reported.’

Police please note: the offence committed is under section 9 of the Animal Welfare Act 2006. "9(1) A person commits an offence if he does not take such steps as are reasonable in all the circumstances to ensure that the needs of an animal for which he is responsible are met to the extent required by good practice." "9(2) For the purposes of this Act, an animal's needs shall be taken to include— (a)its need for a suitable environment, (b)its need for a suitable diet, (c)its need to be able to exhibit normal behaviour patterns, (d)any need it has to be housed with, or apart from, other animals, and (e)its need to be protected from pain, suffering, injury and disease." Under this legislation; a dog is a protected animal, the person who tied it in the sack was responisble for it (on a temporary basis) and a sack does not count as a suitable environment or one in which the dog can exhibit normal behaviour patterns. It is also likely it was left without food and water and the person who left it there had no intention of returning: thus it would have starved to death if no one had happened to walk by. Also note that the dog could have been taken to a vet immediately to ascertain whether it had been caused to suffer, which is contrary to section 4 of the same act.

Thrilled that the owners got their dog back and they were very lucky when you consider the bag was untied by a five year old. It couldn't have been tied very tightly otherwise she wouldn't have been able to do it on her own, so you could assume that the dog would have been able to wriggle free and run off again. If this is 100% correct in that the dog was taken, tied up in a bag and then dumped then how can the police say that no crime has been committed. Theft and cruelty is a crime in anyone's book isn't it?!

the police found time to investigate me because i swore at an over zealous copper on a train and gave me a £300 fine to think about it aswell

Well done chrystal and her family.Ive got a sack ready to put the lowlife in whoever attempted to steal my collie.What possess'sthese ppl to inflict this type of trauma on both pet and owners

Vox Populi@2 Golly Gosh!! From Dog in bag to serial killer in one post. Do you really believe that they would spent time and money on DNA testing etc when the dog has been found and reunited with its owner. It looks to me like they don't believe that it was in the bag as it was a 5 year old girl who discovered it and was the only one who said it was in the bag. Lets face it the Police don't bother to investigate anything nowadays unless its a high profile case. I agree that they could have looked into a bit more but your over the top post does not help.

'no criminal offences were identified'? So stealing someones dog, tying it up in a sack and leaving it for dead is perfectly legal , is it? Codswallop. What the 'police spokesperson' really meant was 'we don't have a clue who did this and we cant be a*sed to try to find out' (probably because they are too busy hassling motorists, groups of 3 or more youths who choose to wear hooded tops, and homeless people). How long would it have taken to check the bag andor the dogs collar and lead for fingerprints, or DNA? Most serial killers start out by torturing and killing animals, so it's not unreasonable to assume that someone who kidnaps a family pet will one day do the same to a child.
