Rapist must tell police if he wants to have sex

A VIOLENT rapist who subjected his victim to '˜degrading and humiliating' abuse left her with 48 bruises, a court heard.

Alcoholic Joseph Kelly, punched and bit a woman, who cannot be named for legal reasons, during the drunken sex attack.

The 50-year-old, who denied rape, also spat on her, Portsmouth Crown Court was told.

The victim suffered a broken finger in the attack.

Now as part of a sexual harm prevention order he must tell police if he intends to have sex.

In a victim personal statement read out by prosecutor Robert Bryan she said she now drank to ‘block out all the memories and flashbacks’.

She added: ‘I’m so traumatised by his actions, the drink helps me to forget.’

The statement said: ‘He left me a quivering mess.

‘He treated me to the point I was scared for my own life.

‘The memories of what he did to me are there 24/7.’

She said they go ‘round and round in my head’.

‘I just want it all to go away so I can live a normal life,’ she added in the statement.

The court heard Kelly had a troubled childhood and was turned into an alcoholic by his father by age 12 or 13.

His sister and a charity worker, from Bournemouth where Kelly lives, spoke to give character witnesses.

During the sentencing it emerged the rape had taken place at a home in Portsmouth.

Sentencing, judge Roger Hetherington jailed Kelly for nine years.

The judge said: ‘You became extremely violent towards her and in your frustration took it out on her not only by physical violence but by a violent rape and attempted rape.

‘The rape and attempted rape were accompanied by punches, or something near to punches, so as to lead to multiple bruising to (the woman), which were shown in various photographs, especially to her face.’

The judge added she also suffered injuries to her legs and back of her legs during the attack, resulting in 48 separate bruises.

‘There were bruises to her buttocks, in particular, and this was all done as part of the sexual violence,’ the judge added.

He said: ‘There was additional degradation and humiliation.’

Kelly, of Stafford Road, Bournemouth, was found guilty of attempted rape and rape in Portsmouth in the incident, which happened in 2015.

He admitted assault occasioning actual bodily harm.

The SHPO lasts for 10 years and he must sign the sex offenders’ register life. A life restraining order bans him from contacting the woman.
