Residents application for judicial review over decision for new homes in Warsash is dismissed

AN APPLICATION by residents for a judicial review over the decision to grant planning permission for six homes in Warsash has been dismissed and costs awarded to Fareham Borough Council.

Save Warsash and the Western Wards put forward a judicial review claim against the council’s decision to grant planning permission for the detached homes on Greenaway Lane.

Campaigners put forward eight reasons for judicial review but had their claim dismissed by the High Court of Justice.

Members of the planning committee were told about the decision by councillor Nick Walker, chairman of the committee.

Cllr Walker said: ‘An order of the High Court was made on December 7 refusing permission to bring the judicial review claim on all eight grounds.

‘The court’s view was that officers had correctly interpreted and applied the Natural England guidance on achieving nitrate neutrality, had properly advised the planning committee, and that the committee had made a lawful decision.’

Save Warsash and the Western Wards have the option to ask the court to reconsider its decision at a hearing. The deadline is December 21.
